How long can you stay in Canada with a study permit?

A study permit is usually valid for the length of your study program, plus an extra 90 days. The 90 days let you prepare to leave Canada or apply to extend your stay.

1. If you are taking prerequisite courses

If your school asks you to take courses before they accept you into the main program (you have conditional acceptance), your study permit will be valid for the length of those courses, plus 1 year. When you get accepted into the main program, you must then apply to extend your stay as a student.

2. If you finish your studies after your study permit expires

If you don’t finish your courses before the date on your permit, you must apply to extend your stay as a student. Incase if you don’t, you need to stop studying and leave Canada.

3. If you finish your studies before your study permit expires

If you finish your studies early, your permit will stop being valid 90 days after you complete your studies, no matter what day is printed on the study permit.

Prerequisites to apply for study permit:

  • Should be enrolled at a designated learning institution (DLI)
  • Prove that you have enough money to pay for your:
    • Tuition fees
    • Living expenses for yourself and any family members who come with you to Canada and
    • Return transportation for yourself and any family members who come with you to Canada
  • Obey the law, have no criminal record and get a police certificate (if required)
  • You are in good health and get a medical exam (if required)
  • Prove to an officer that you will leave Canada when your study permit expires

Working while you study in Canada

If you like to get a part-time job to help support yourself while studying in Canada, you can now qualify to work on or off-campus for up to 20 hours during university semesters and full-time during breaks such as the winter or summer holidays, without the need for a work permit.

To qualify, you must:

  • Have a valid study permit
  • Be a full-time student
  • Enrolled at a designated learning institution at post-secondary level or, in Quebec, a vocational program at secondary level
  • Studying in an academic, vocational or professional training program that leads to a degree, diploma or certificate that is at least six months in duration.

You will also need a Social Insurance Number (SIN) from Service Canada to work in Canada or to receive benefits and services from government programs.

Study permit will become invalid 90 days after you have completed your study program, so you will need to acquire a post-graduation work permit if you want to stay in Canada after your studies and seek work. This is valid for three years.

Canada has a new announcement for migration aspirants. Recently, the federal government of Canada has announced new pathways for Canadian permanent residency for more than 90,000 international graduates and essential temporary workers.

 

The following is a list of the six new immigrations streams as well as their intake caps.

  • Workers in Canada – Stream A for health care workers (20,000 applications)
  • Workers in Canada – Stream B for essential non-health care workers (30,000 applications)
  • International graduates (40,000 applications)
  • Workers in Canada – Stream A for French-speaking health care workers (no limit)
  • Workers in Canada – Stream B for French-speaking essential non-health care workers (no limit)
  • French-speaking international graduates (no limit)

 

These special public policies will be granting permanent resident status to international graduates and temporary workers that were –

  • Already in Canada, and
  • Possess the skills as well as experience required by Canada for fighting the COVID-19 pandemic and accelerating the economic recovery of Canada.

 

Effective May 6, 2021, IRCC will start accepting applications under 3 streams – for temporary workers in healthcare [20,000 applications], for temporary workers in other selected occupations [30,000 applications], and for international students that had graduated from a Canadian institution [40,000 applications].

 

These 3 streams will remain open until November 5, 2021, or until their intake limit had been reached.

In order to be eligible for any of these 3 steams, the international graduates and workers must meet certain specific eligibility requirements. These are –

  • Workers must have a minimum of 1 year of Canadian work experience in a health-care profession or any other pre-approved essential occupation.
  • International graduates must have completed an eligible Canadian post-secondary program within the previous 4 years [not earlier than January 2017].

 

The skilled newcomers and international graduates to be welcomed into Canada under the new streams will help in the creation of jobs in Canada, driving long-term growth in Canada.

These public policies will be applicable to workers in 40 health-care occupations, along with 95 other essential jobs across a diverse range of fields that include caregiving and food distribution.

 

Why is Canada offering these Programs?

 

The travel restrictions in place to slow the spread of COVID-19 has had major impacts on the labour market. Canada typically depends on immigrants coming in from abroad to address labour shortages.

Canada has set ambitious immigration targets for 2021, looking to welcome 401,000 new immigrants by the end of the year. Due to its commitment to meeting this target, Canada introduced the six new immigration streams. These streams help those who are already residing in the country get permanent residence.

Half of the streams are for French-speakers. This is because Canada is looking to increase bilingual and French-speaking immigrants outside of Quebec.

Let’s get started, what is a CRS score?

Canada’s Express Entry immigration system is competitive. Only the candidates with the highest Comprehensive Ranking System (CRS) scores receive invitations to apply for permanent resident status.

The CRS is a points-based system that is used to assess and score your profile and rank it in the Express Entry pool. Below are the points to look after:

  • Second Language: You can claim points for both English and French under the CRS. If you are capable in both languages, make sure that you take an approved language test in both English and French to ensure that you’re getting as many points as possible.

  • Retake your Language Test: If you haven’t maximized your approved language test scores, then this option could be the key to you getting a competitive CRS score.

  • Complete another educational program: This is definitely a long-term strategy for improving your CRS score. Regardless, gaining more education can result in a much higher CRS score.   • Get a Canadian Job Offer: While the value of a qualifying job offer with respect to your CRS score is not as great as it once was — in most cases, down to 50 CRS points from a previous value of 600 points — obtaining a job offer remains an important factor.

In addition, the survey suggests that countries considered to be ‘safe and stable’ are not necessarily viewed as being ‘open and welcoming.’ However, Canada is one of the top countries that are considered to be both.

In fact, Canada has introduced some measures to allow international students to travel to their desired destination. Students who wish to travel to Canada only need to be attending a college or university that has obtained approval on its COVID-19 readiness plan from the provincial government in which the institution is in. It does not matter where the student is travelling from.

The first survey was conducted in May 2020. Findings from that survey showed Canada as one of the countries who are ahead of the pack, alongside New Zealand and Australia.

Research was repeated in September 2020. Canada had improved its overall position since May, but was now competing with the United Kingdom for the top spot, instead of the Oceanic states.

Benefits of Canadian Work Permit

Working in Canada has many benefits. Canadian labour laws ensure that workplaces have a high-degree of safety and that all employers follow certain laws and regulations to ensure the well being of their employees. As well, Canadian wages are competitive and foreign nationals are required, by law, to be offered wages equivalent to their Canadian counterparts.

The proposed work permit will allow foreign employees working in Canada to leave an abusive employer and look for other options. It can create competitive working conditions for both foreign and domestic workers. But for every job offer that a foreign worker is willing to accept, it requires an approved LMIA to ensure the protection of the local labor market.

Foreigners who come to work under the Temporary Foreign Worker Program can work in the country for up to one year. With the proposed work permit foreign workers can arrive at a new job after working for another employer with only a few months left in their work permit before it expires.

Eligibility Criteria

  • Obey the law and have no record of criminal activity
  • Not plan to work for an employer listed with the status “ineligible” on the list of employers who failed to comply with the conditions
  • Give the officer any other documents they ask for to prove you can enter the country

Process and Procedure

The process for obtaining a Canadian work permit varies greatly depending on which type of work permit a person is applying. For example, an international student studying in Canada will often times be automatically issued authorization to work part-time as part of their study permit authorization.

Most closed work permit applications require that a foreign national has an official job offer from a Canadian employer which is supported by a Labour Market Impact Assessment (LMIA). Even those who are LMIA-exempt or exempt from requiring a work permit should be aware of the unique documentation they need to prepare in order to ensure they are granted entry to Canada. There are two general pathways for obtaining a Canadian work permit: a closed work permit and an open work permit.

You will get an approval letter that says you’re allowed to work in Canada. This letter is called the port of entry letter of introduction.

You should bring this letter with you when you travel to Canada and present it at the port of entry. This letter is not your work permit.
